Terms of Service
Effective date: [[EFFECTIVE DATE, e.g. 1 October 2026]]
These Terms of Service (“Terms”) are an agreement between [[LEGAL ENTITY NAME]] (“Granularity”, “we”, “us”) and the business on whose behalf you use the Granularity platform (“Customer”, “you”). By creating an account, joining a workspace or using the Service you accept these Terms. If you accept on behalf of a business you confirm you have authority to bind it.
1. The Service
Granularity is a marketing analytics platform that imports reporting data from the advertising, analytics and commerce platforms you connect, and provides dashboards, reports and AI-assisted analysis based on that data (the “Service”). We may improve or change the Service over time, and will not materially reduce its core functionality during a paid term without notice.
2. Accounts and workspaces
You must provide accurate account information and keep your credentials confidential. A workspace belongs to the Customer organisation; its administrators control who can join and what they may do. You are responsible for all activity under your account and for your team members’ compliance with these Terms.
3. Connected platforms and your data
When you connect a third-party platform (for example Google Ads, Google Analytics, Google Search Console, Meta Ads or Shopify) you authorise Granularity to access that platform on your behalf using the permissions you grant, and you confirm you are entitled to grant them. Your use of each platform remains subject to that platform’s own terms. You may disconnect a platform at any time.
You retain all rights in the data you connect, upload or create (“Customer Data”). You grant us a licence to host, process, display and transmit Customer Data only as needed to provide and support the Service, as described in our Privacy Policy. We will not sell Customer Data or use it to train general-purpose models.
4. AI features
The Service includes features that use large language models to answer questions, summarise data and suggest actions. AI output may be inaccurate or incomplete. It is provided for your evaluation and does not constitute professional advice; you are responsible for decisions you make based on it, including any changes you make to your advertising accounts.
5. Acceptable use
You agree not to:
- use the Service in violation of law or third-party rights;
- connect platforms or accounts you are not authorised to access, or upload data you are not entitled to process;
- attempt to access another customer’s workspace or data, or to probe, scan or circumvent security controls;
- reverse engineer the Service, resell it, or use it to build a competing product;
- send abusive, automated or excessive traffic that degrades the Service.
6. Trials, fees and payment
New workspaces may receive a 14-day free trial without a payment method. Paid plans are billed in advance for the term you select and renew automatically unless cancelled before renewal. Fees exclude taxes. We may change prices with at least 30 days’ notice, effective at your next renewal. Where a Customer brings its own AI provider key, usage fees for that provider are billed by the provider directly.
7. Intellectual property
The Service, including its software, design, models of analysis and documentation, is owned by Granularity and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. Feedback you give us may be used without obligation.
8. Confidentiality
Each party will protect the other’s non-public information with at least reasonable care and use it only to perform under these Terms. Customer Data is your confidential information.
9. Data protection
Our handling of personal data is described in the Privacy Policy. Where we process personal data on your behalf as a processor, our data processing terms apply. [[REVIEW: link a DPA if one exists.]]
10. Suspension and termination
You may cancel at any time; the Service remains available until the end of the paid term. We may suspend or terminate access for material breach, non-payment or where required to protect the Service or other customers, with notice where practicable. After termination your organisation enters a 30-day grace period, after which its data is deleted as described in the Privacy Policy.
11. Warranties and disclaimers
We will provide the Service with reasonable skill and care. Except as expressly stated, the Service is provided “as is” and we disclaim all implied warranties, including fitness for a particular purpose and accuracy of imported or AI-generated content. We do not control third-party platforms and are not responsible for their availability, data or changes to their APIs.
12. Limitation of liability
To the extent permitted by law, neither party is liable for indirect, consequential or special damages, or for lost profits or revenue. Each party’s total liability under these Terms is limited to the fees paid by the Customer in the 12 months before the event giving rise to the claim. These limits do not apply to breach of confidentiality, infringement of the other party’s intellectual property, or liability that cannot be limited by law.
13. Changes to these Terms
We may update these Terms by posting a new version here. For material changes we will notify workspace administrators at least 30 days before they take effect. Continued use after that date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of [[COUNTRY / GOVERNING LAW]], and the courts there have exclusive jurisdiction, without prejudice to mandatory consumer or data-protection rights.
